How U.S. Regulation Treats HYPE
U.S. treatment of HYPE should be analyzed separately across the token itself, staking, custody, derivatives referencing HYPE, and investment products that hold or offer exposure to it.
There is no single U.S. rule called “the HYPE regulation.” The SEC/CFTC's March 2026 interpretation supplies a crypto-asset taxonomy and clarifies that asset status and investment-contract transactions are separate questions. Meanwhile, CFTC product filings show regulated HYPE futures products, and public SEC filings show U.S. companies holding and custodying HYPE. These facts do not by themselves resolve every product or transaction involving HYPE.
HYPE as an asset
The 2026 federal framework should be applied to HYPE's characteristics and the specific transaction being evaluated. Do not infer a definitive asset classification solely because a regulated futures contract exists or a public company holds the token.
Staking
The SEC interpretation addresses protocol staking in its broader framework, but an institution should distinguish native delegation from a managed investment arrangement or yield product with additional promises and intermediaries.
Provider structure can change the analysis even when the underlying network activity is the same.
Custody
Public company filings describe HYPE custody through institutional and self-custody arrangements. Custody regulation depends on the custodian, client type, legal entity, and service rather than the asset alone.
Derivatives
CFTC filings list HYPE Futures and HYPE Perp Style Futures certified on May 18, 2026. Those contracts live inside a regulated derivatives framework. Hyperliquid-native HYPE perps are a different access route and should not be conflated with them.
Investment products
A fund, trust, ETP, treasury company, or other vehicle holding HYPE creates a security or investment-product layer around the underlying asset. Analyze the wrapper separately.
