Hyperliquid Regulation and Tax in India
A current map of Indian VDA tax and TDS rules, the April 2026 Income-tax Act transition, and why Hyperliquid perpetuals need separate classification.
Indian tax treatment depends on what the transaction legally is, not simply whether it happened on Hyperliquid. Spot transfers of assets that fall within India's Virtual Digital Asset definition have a specific tax regime. A cash-settled perpetual, funding payment, lending position, or business trading activity can require a separate classification analysis.
There is also an important 2026 transition in the tax law. TDS events on or after April 1, 2026 are governed by the Income-tax Act, 2025 rather than the repealed Income-tax Act, 1961.
The 30% VDA-income rule remains the practical baseline for spot VDAs
The Income Tax Department's current ITR guidance still states that gains from Virtual Digital Assets are taxed at 30% plus applicable surcharge and 4% cess under section 115BBH, and that VDA income is disclosed transaction by transaction in Schedule VDA.
The Department's current VDA material also states that the special computation generally allows the cost of acquisition but not other expenditure deductions or loss set-off under the VDA regime.
That is the relevant starting point when a transaction is actually a transfer of a VDA. It should not be automatically extended to every product that references a crypto asset.
TDS changed statutory references on April 1, 2026
For payments or credits on or before March 31, 2026, the old Income-tax Act, 1961 provisions apply. Under that framework, VDA-transfer TDS was associated with section 194S and Form 26QE for specified challan-cum-statement cases.
For relevant transactions on or after April 1, 2026, the Income Tax Department says deductors must use the corresponding withholding provisions of the Income-tax Act, 2025. The new framework uses section 393, and Form 141 consolidates the former 26QB, 26QC, 26QD, and 26QE challan-cum-statement workflows. Form 141 includes a dedicated schedule for TDS on transfer of Virtual Digital Assets by an individual or HUF.
This transition matters when reading older crypto-tax explainers. A page that describes section 194S and Form 26QE as the current filing route without an April 2026 qualification is stale.
Perpetual futures need a separate classification analysis
A perpetual contract can give price exposure without transferring the referenced token itself. That means a perp PnL event is not automatically identical to a spot VDA transfer.
Depending on the product structure and the taxpayer's facts, questions can arise around business income, derivative characterization, source and situs, funding payments, loss treatment, and whether the transaction falls within the special VDA-transfer regime at all.
This article therefore does not apply the 30% VDA headline or spot-transfer TDS mechanics to every Hyperliquid perpetual trade. Material activity should be reviewed by an Indian tax professional who understands both derivatives and onchain systems.
Offshore and FEMA issues are separate from income tax
Indian residents may also need to consider foreign-exchange rules, offshore asset or income reporting, remittance history, business-regulatory obligations, and the legal characterization of counterparties or protocol access. The absence of a domestic exchange does not by itself remove Indian compliance obligations.
These are separate questions from the rate at which a VDA transfer is taxed.
Keep records that let the transaction be classified later
Preserve wallet addresses, deposits, withdrawals, token transfers, spot trades, perpetual fills, realized PnL, funding, fees, stablecoin conversions, and the INR conversion methodology used for each relevant event.
Onchain records are useful evidence, but they do not determine the tax classification by themselves.
Status
Verified September 10, 2026. This is an educational map, not tax or legal advice. Indian tax law and reporting systems changed materially in 2026, so current Income Tax Department guidance should take priority over older section-number references.
