Hyperliquid Regulation in the European Union

EU treatment separates MiCA crypto-asset services from MiFID financial instruments, and ESMA has emphasized that perpetual products can fall under derivatives and CFD-style investor-protection rules.

In the EU, MiCA is not a catch-all law for every blockchain product. MiCA excludes crypto assets that qualify as financial instruments, while derivatives are analyzed under MiFID II and related rules. ESMA has specifically addressed perpetual-style leveraged products and stated in February 2026 that many offerings marketed as perpetual futures can fall within existing CFD product-intervention measures when they meet the definition.

MiCA versus MiFID

MiCA governs defined crypto-asset issuers and service providers, but Article 2 excludes assets that qualify as financial instruments. ESMA's guidelines help national authorities decide when a crypto asset belongs inside the financial-instrument perimeter.

Perpetuals

ESMA's February 2026 statement tells firms to assess whether perpetual futures or perpetual contracts are CFDs. When they are, leverage limits, margin close-out, negative-balance protection, risk warnings, and benefit restrictions can apply under national product-intervention measures.

Professional and retail treatment can differ.

DeFi access

A decentralized protocol can be technically reachable from the EU while an EU-regulated firm still has obligations around service authorization, appropriateness, marketing, execution, or distribution.

Do not infer permission from web accessibility.

Tokenized assets

Equity, fund, or derivative tokens can fall under MiFID rather than MiCA. The legal claim and payoff drive classification.
